Terms of Service
The agreement governing the Mostly Right hosted service: a monthly subscription to our published catalog of public data sources, the API key that accesses it, and the rules around both.
Effective August 4, 2026 · Mostly Right Inc., Delaware
1. Agreement
These Terms govern access to the Mostly Right hosted service (the "Service") operated by Mostly Right Inc., a corporation organised under the laws of the State of Delaware, United States, located at 1111B South Governors Avenue, Suite 56114, Dover, DE 19904, US ("Mostly Right", "we", "us"). By creating an account or using the Service you agree to these Terms. If you are agreeing on behalf of an organisation, you represent that you have authority to bind it.
2. What the Service is
The Service provides:
- a hosted source catalog (the "Manifest"): our editorial compilation of addresses, transition dates, and metadata describing publicly available data sources; and
- an API key authenticating your access to it.
The Service is delivered on a publishing model, not a real-time serving model. We do not commit to any freshness, latency, or uptime service level. The accompanying SDK is distributed through npm and PyPI and requires an active subscription's API key to resolve data sources; it does not operate without the Service.
3. What the Service is not: third-party data and BYO credentials
The Manifest describes how to reach public data sources. For several sources the Service does not retrieve, store, cache, or redistribute the underlying data at all. Instead you supply your own credentials ("BYO-key" sources) and your client retrieves data directly from the third party.
At the effective date of these Terms, 7 of 21 catalogued sources are BYO-key, including FRED/ALFRED, Kalshi, and Polymarket.
For those sources:
- your use is governed by your agreement with that third party, not by these Terms;
- we are not a party to that relationship and have no control over it;
- you are responsible for complying with their terms, including any restrictions on storage, caching, redistribution, or automated access; and
- we do not warrant your right to use that data for any purpose.
For sources we do redistribute, we do so only where the licence permits it. Those are predominantly public-domain government sources (e.g. NWS, AWC, NWS-CLI, GHCNh-US, IEM, BLS/BEA/Fed, GOES/EUMETSAT), subject to attribution requirements you agree to preserve.
Certain data carries additional restrictions we pass through to you, including WMO Resolution 40, which restricts redistribution of non-US GHCNh records. Where the Service flags a restriction in the Manifest's advisories, you agree to observe it.
4. Subscription and fees
- Access requires an active paid subscription. There is no free plan and no trial.
- Fees are USD 29.00 per month, billed in advance. Your subscription renews automatically every month until you cancel. The recurring charge, the renewal schedule, and the way to cancel are disclosed before you subscribe, and we require your explicit acceptance of these Terms at checkout.
- Payment is processed by Stripe. We do not receive or store your full card details.
- You can cancel online from your account at any time, or by writing to team@mostlyright.md; see §5.
- Fees exclude taxes. Where we are required to collect sales tax or VAT, it is shown and added at checkout.
- We may change fees on at least 30 days' written notice, effective at your first renewal after the notice period ends. If you do not agree to a fee change, cancel before it takes effect.
5. Cancellation and refunds
- You may cancel at any time from your account. Cancellation takes effect at the end of the current billing period.
- Access continues until the end of the paid period. Your API key is disabled thereafter.
- 14-day guarantee. If you are not satisfied with your first subscription, tell us within 14 days of your initial purchase at team@mostlyright.md and we will refund it in full.
- Renewal payments are not refunded pro rata; when you cancel, you keep access until the end of the period you paid for.
- If you are a consumer in the EU or UK, the 14-day guarantee operates alongside your statutory 14-day withdrawal right. By subscribing you request immediate access to the Service; if you withdraw within the statutory period, we will refund you as described above. Nothing in these Terms limits rights you have under mandatory consumer law.
6. Accounts and API keys
- You authenticate via Google or GitHub OAuth. You are responsible for the security of that account.
- Your API key is displayed once, at issuance. We store only a hash and cannot recover the original. If it is lost, you must rotate it.
- You are responsible for all use made with your key, including by anyone you share it with.
- Rotation invalidates the previous key immediately, with no overlap period.
- You must notify us promptly of suspected compromise.
7. Acceptable use
You agree not to:
- resell, sublicense, or redistribute the Manifest as a standalone product;
- share your API key with anyone outside your organisation, or use one subscription to serve multiple organisations;
- attempt to circumvent authentication, rate limits, or quotas;
- use the Service in violation of any third-party source's terms (see §3); or
- use the Service unlawfully.
We may suspend access for breach. Unless the breach creates a security risk, harms other users, or is plainly unlawful, we will notify you first and give you a reasonable opportunity to cure it before suspending.
8. Privacy
Our handling of personal data is described in our Privacy Policy. We process the account data OAuth provides, and we log each Manifest fetch, recording a hashed key identifier, timestamp, catalog version, and SDK version.
We deliberately do not log IP addresses, user agents, or which individual sources you query. The Manifest is served whole, so our records cannot reveal which data sources are of interest to you.
9. Warranties and disclaimers
The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
We specifically do not warrant that:
- the Service will be uninterrupted or error-free;
- the Manifest is accurate, complete, or current;
- any third-party source will remain available, or at the address the Manifest states; or
- the data you obtain is fit for trading, financial, or any other decision-making purpose.
Nothing provided by the Service is financial, investment, or trading advice. You are solely responsible for decisions made using it.
10. Limitation of liability
To the maximum extent permitted by law, our aggregate liability arising out of or relating to the Service will not exceed the fees you paid in the twelve months preceding the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost trading opportunities, or lost data.
Nothing in this section excludes or limits liability that cannot be excluded or limited under applicable law, and nothing in these Terms affects statutory rights you hold as a consumer.
11. Intellectual property
We retain all rights in the Service and the Manifest as a compilation. Your subscription grants a non-exclusive, non-transferable right to use it during your subscription term.
The underlying public-domain data is not owned by us. Our rights subsist in the selection, arrangement, verification, and editorial content of the Manifest, including settlement-map provenance and advisories, not in the underlying facts.
The SDK is licensed separately under its own terms and is unaffected by these Terms.
12. Termination
You may end this agreement at any time by cancelling your subscription; cancellation works as described in §5, and your access continues to the end of the paid period. We may suspend or terminate immediately for material breach or unlawful use; on such termination your API key is revoked and access ends.
13. Changes to these Terms
We may update these Terms. Material changes will be notified by email or in-product at least 30 days before taking effect. If you do not agree to a change, cancel before it takes effect; continued use after that constitutes acceptance. Updated Terms are dated when published.
14. Governing law
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules. The state and federal courts located in Delaware have exclusive jurisdiction, and each party consents to venue there.
If you are a consumer, this choice of law does not deprive you of the protection of mandatory consumer-protection provisions of the law of the country where you live, and you may also be entitled to bring proceedings there.
The UN Convention on Contracts for the International Sale of Goods does not apply.
